Municipal liability
Under the New Jersey Tort Claims Act there are many limitations applicable when an injured party wants to sue any municipality or government agency in a tort action. It is absolutely critical that a Notice of Claim be filed with the municipality within 90 days of the accident or incident or the injury party will forever be barred from suing. This is a prerequisite. A lawsuit cannot be filed until six months after the filing of the Notice of Claim which allows the municipality to investigate the claim.
